Trademark registration is the process of putting a trademark under legal protection.
When a trademark is registered, the trademark owner is granted certain rights and protections.
These rights usually cover the name, logo, symbol or other identifying elements of the trademark.
Legal Protection: Trademark registration legally protects your trademark and prevents others from using your trademark without permission.
Trademark Value: Trademark registration increases the value of your brand.
A registered trademark is considered trustworthy and recognizable by customers.
Competitive Advantage: A registered trademark provides a competitive advantage over your competitors.
Legal protection of your trademark supports your marketing and sales.
License Income: A registered trademark offers the opportunity to generate revenue by licensing to others.
Other companies may have to pay you a license fee when they want to use your trademark.
Legal Assurance: Trademark registration creates a legal basis to protect your trademark.
It allows you to legally defend your rights in case of any infringement of your trademark.
Trade Reputation: A registered trademark enhances your commercial reputation in the eyes of your customers.
It is recognized as a symbol of reliability and quality.
Access to International Protection: Trademark registration allows you to get your brand protected internationally.
This provides opportunities to expand and market your brand in different countries.
These benefits demonstrate why trademark registration is important for businesses.
Trademark registration is an important step for the long-term success of your business and enhances the credibility, reputation and value of your brand.
The term of protection in trademark registration is ten years from the date of application.
Six months before the end of this period, the renewal period starts.
With the renewal request to be made in due time, the registration right will continue for the next ten years.
As the renewal process is carried out, the trademark right will continue indefinitely.
In trademark registration, the term "commodity" is a term used to determine the scope of protection of the trademark.
When registering a trademark, it must be specified for which goods or services the trademark will be used.
Therefore, the person or organization applying for registration must indicate in which classes it intends to use the mark.
Article 6 (pursuant to Article 9) trademark classes define the area of protection of the registered mark for specific goods or services.
The International Classification provides for the division of trademarks into specific categories of goods and services.
These classes facilitate the organization and administration of trademark applications and registration.
For example, if you want to register a trademark for apparel, the relevant classes cover apparel.
Another example, if you want to register a trademark for software services, the relevant classes cover software and IT services.
In this way, when applying for trademark registration, it is very important to correctly specify the classes in which the trademark will be used because this determines the scope of protection of the trademark.
A trademark can only be registered in Turkey by filing a registration application with the Turkish Patent Institute.
Establishing Infringement: As a first step, the trademark owner must establish the infringement of the counterfeited trademark.
This may involve examining the products or services where the mark is being imitated.
Seeking Legal Advice: The trademark owner should seek legal counsel to understand the situation and ensure that appropriate steps are taken.
Trademark law experts can advise the trademark owner on the best course of action and help take steps to protect its legal rights.
Filing a Notice of Infringement: The trademark owner may serve a written notice of infringement to the person or organization using the counterfeited trademark.
In this notification, the trademark owner is requested to respect the rights of the registered trademark and to stop the imitation.
Initiation of Legal Action: If the infringement is not stopped, the trademark owner can take legal action.
This may mean filing a trademark infringement lawsuit or taking other legal measures.
Legal action may vary depending on the country and the laws protecting the infringed trademark.
Cooperation with Trademark Protection Organizations: In some cases, the trademark owner may cooperate with trademark protection organizations to protect the counterfeited trademark.
These organizations work to notify the trademark owner of infringement and assist the trademark owner with legal remedies.
In the event of imitation of a registered trademark, the trademark owner must act effectively and quickly to protect its legal rights.
This is important to protect the reputation and value of the trademark.
Within six months before the expiration of the ten-year term of the trademark registration and within six months after the expiration of this term, the trademark right is renewed for another ten years.
Penalties are applied for renewals made after the trademark expires.
If the specified periods are exceeded, the trademark right expires and becomes open to new applications.
A trademark can be registered only once in a class of occupation.
It is not possible for two companies doing the same business to own the same trademark separately.
However, there is no obstacle to the registration of a trademark in different occupational classes, except if it is a famous trademark.
For example, a trademark registered in garment products (25.01) can be registered by the same company or other companies in industrial chemicals (01.01) if it is not a famous trademark.
